By accessing, browsing, and/or using Sanam (including services, website, mobile application, platform, and media), you acknowledge that you have read and understood the Terms and Conditions of this Privacy Policy in its entirety, including any updates that may occur and be posted on our website, mobile application, and/or other media from time to time. Sanam reserves the right to review and update this Privacy Policy, at our discretion. 1.0 Definitions

  • Sanam: it refers to the business entity including the website (www.sanam-app.com), mobile application, and other media held and run by the business.
  • Pronouns such as “we”, “us”, and “our” refer to Sanam.
  • Pronouns such “you” and “your” refer to the user of Sanam.
  • The word “user” refers to the user of Sanam’s Services.
  • Personal Information: information that identifies the user or can be used to identify or contact the user such as name, email address, postal address, or phone number.
  • Terms: it refers to the laws, policies, regulations, and conditions set out in this Policy.
  • Service Provider: any third-party organization that works with Sanam to provide services and/or information.
  • Open Banking: defined by the Saudi Central Bank (Open Banking Policy, 2021) as a technological innovation enabling users to securely share their data with third parties.
  • Account Information: the financial and non-financial information of the user’s bank account, credit card, or e-wallet including without limitation the account type, account number/IBAN, account name, account balance/value, deposits, withdrawals, fund transfer, and payments from and to the account.

2.0 Collected Personal Information

The user has a complete control over their money and online identity. The information that Sanam collects from the user or about their use of our Services is dependent on how the user accesses and uses the Services we offer.

We use the information we collect to provide, maintain, and improve our Services throughout the application to offer you the best user experience.

2.1 Visitor Information

If you are a visitor to Sanam, we do not collect any personal or sensitive information from or about you from the unsecure areas of the Sanam’s website. If you are a visitor who does not log in to the Sanam’s Service with a username and password, you therefore remain anonymous. We do not ask for any personal information from visitors.

2.2 User Information

The user will need to register an account with Sanam, either through our website or our mobile application, to access the secure, password protected features of our Services. When registering an account with Sanam, the user will be asked to provide:

  • A phone number and/or an email address to identify the user account;
  • Basic personal information (first and last name, date of birth and gender) to configure the Sanam service for your use;
  • Personal information about the socio-economic situation (income range, occupation, family structure and location) to help us customize offers and improve the user experience at Sanam. Sharing this type of information is optional and depends entirely on what the user wants to disclose to us.
  • Depending on the user’s choice of Service, we may collect other personal information including credit card details (for payment purposes only).

We may collect additional data/information from you when you fill out and submit online forms, make spending or savings decisions, take actions on the website or mobile application, and/or participate in marketing activities. Such data may include user feedback, purchasing behaviors, and inputs from participating in marketing activities. Any data collected in relation to these activities will be treated in accordance with this Privacy Policy, except as specifically set forth in the rules for those promotions and giveaways.

We store personal data associated with your account for as long as your account remains active. If you decide to remove your account, we will delete your account data within 14 days. We store other personal data for as long as necessary to carry out the purposes for which we originally collected it and for other legitimate business purposes, including to meet our legal, regulatory, or other compliance obligations.

We only process personal information for these “legitimate interests” after considering the potential risks to your privacy—for example, by providing clear transparency into our privacy practices, offering you control over your personal information where appropriate, limiting the information we keep, limiting what we do with your information, who we send your information to, how long we keep your information, or the technical measures we use to protect your information.

You have a right of access, rectification, restriction, erasure and data portability. Please contact us if you wish to exercise these rights.

Further, subject to specific requirements, you have the right to object to processing of your personal data based on legitimate interests or a public interest or an official authority vested in us.

Generally, you can review and edit your Personal information in the Account by logging in and updating the information directly.

3.0 Collected Financial Information

Under the direct supervision of the Saudi Central Bank (previously known as Saudi Arabian Monetary Authority, or SAMA), we may collect financial information from the user. Sanam adheres to the Open Banking Policy issued by SAMA to ensure the security and privacy of the user’s financial information. The process of accessing, collecting, and using the user’s financial information is governed by the Open Banking Policy (Click here to review the policy).

To benefit from all Sanam’s Services, the user is encouraged to link their bank account/s, credit card/s, and/or e-wallets with their Sanam Account. This will allow Sanam to automatically track, categorize, and analyze spending for insights into managing finances and increasing savings.  Sanam and its Service Providers (e.g. third-party financial institutions) will have a limited access to the user’s bank account/s and credit card/s. The access is limited to the retrieval of the user’s Account Information only. Thus, Sanam and its Service Providers cannot make any financial action or changes to the user’s account/s and/or credit card/s (e.g. withdraw money, transfer funds, issue cards …etc.) without the user permission.

Therefore, by linking your bank account/s, credit or debit card/s, and/or e-wallets, you:

  1. consent to our use of your Account Credentials, as your authorized agent for the purpose of accessing your Account Information from third party financial institutions (e.g., banks, mortgage brokers, superannuation funds, and open banking service provider) in order to provide you with the services you access and use through Sanam.
  2. acknowledge that when we use your Account Credentials, we can access your Account Information with third party financial institutions on your behalf and, in doing so; you may not be in compliance with the terms and conditions of your financial institution.

When Sanam collects your personal and financial information, it is then encrypted and held digitally on secure servers located in Saudi Arabia, accessible by Sanam and Service Provider staff only, and in accordance with our Privacy Policy and all domestically applicable laws.

4.0 Use of Personal Information

4.1 Use of Identity-Revealing Information

We use personal information mainly for providing the services and products needed for a unique user experience. It is also possible that we use personal information from time to time to provide you with information that, as we believe, of interest and value to you. This includes information about our Services, policy changes, updates to our Agreements, developments or changes to the Sanam business, news, announcements, notifications, and/or promotional information.

We will use your personal information for the purpose disclosed at the time of collection, or otherwise as set out in this Privacy Policy. Except as specifically set out in this Privacy Policy, we will not sell or disclose your personal information to any other person or use your personal information for any other purpose without your prior consent, unless authorized or required by law.

Generally, we will only use and disclose your personal information for the following purposes:

  • to provide you with information you request about us or the products or services we offer through the Sanam Service;
  • to provide information to persons expressly authorized by you;
  • to manage the Sanam Service (including your Account);
  • to arrange for and provide products or services you request from time to time;
  • to access or directly link to Third-Party Websites and your Third-Party Accounts;
  • to determine and notify you of what products or services (including third party products and services) we consider are likely to be of most interest to you;
  • to process and obtain payment for any products or services you apply for through Sanam;
  • to understand how you use our Service and to help us improve Sanam, our marketing or the way we do business;
  • if necessary, to verify your identity or age (i.e. over 18); and
  • to contact you for direct marketing and promotional purposes including providing you with information about new products or services, events and special offers, unless you tell us that you do not wish to receive this type of information.

4.2 Use of Anonymous and Aggregated Data

We may use your data and any personal information, which you have provided to us, to enhance the service we are providing to you. Sanam may use anonymous and aggregated data from our users, and disclose this in a non-personally identifiable manner to third parties, including:

  • advertisers and other third parties for their marketing and promotional purposes such as how many users clicked on their advertisement;
  • other users of the Sanam Service in order to provide them benchmarks for comparing themselves against the broader Sanam community;
  • approved entities/organizations wishing to conduct scientific and/or market research into consumer, financial behaviors, or other important and useful topics; and
  • partners who provide their customer with a partner sponsored version of the Sanam Service.

We will keep personal information for the period necessary – reasonably – to achieve the objectives for which personal information has been collected as set out in this Privacy Policy, and in accordance with the prescribed or permissible period under the System.

We will never rent or sell your Personal Information to others. We may share your Personal Information with third parties for the purpose of providing or improving the Service to you. If we do this, such third parties’ use of your Personal Information will be bound by obligations of confidentiality.

We may store Personal Information in locations outside our direct control (for instance, on servers or databases located or co-located with hosting providers).  Any Personal Information or content that you voluntarily disclose for posting to the Service becomes available to the public, as controlled by any applicable privacy or website customization settings. To change your privacy settings on the Service, you may visit your Sanam account settings page.

5.0 Disclosure of Information

5.1 Disclosure of Personal Information

Without prejudice to our responsibility to keep all personal information confidential and safe, we may disclose personal information in these certain events:

  1. in compliance with laws, rules, or regulations in Saudi Arabia;
  2. to comply with any legal processes;
  3. to respond to requests from government or public authorities;
  4. to enforce our Policies and Agreements;
  5. to protect our commercial rights (operations) or those of any affiliated entities;
  6. to protect the rights, privacy, safety or property of Sanam, its affiliated entities, you, or others; and
  7. to permit us to pursue available remedies or limit the damages that we may bear/sustain.

5.2 Disclosure of Account Credentials

We may disclose your Account Credentials to our account aggregation Service Provider. The disclosure of this information is strictly governed by the Open Banking Policy issued by SAMA (Click here to review the policy) as well as our privacy and security obligations to you, and is necessary as our account aggregation Service Provider offers the means by which you can link your financial data to your Sanam Account. Therefore, you:

  1. consent to our disclosure of this information as your authorized agent for the purpose of allowing our account aggregation Service Provider to access your Account Information with third party financial institutions (e.g., banks, mortgage brokers, credit card companies, and e-wallets) in order to allow us to provide you with the services you request.
  2. understand and acknowledge that, when our account aggregation Service Provider accesses your Account Information, your identity is not directly ascertainable from the transaction data, which is part of your Account information.

 6.0 External Websites and Platforms

Our website, mobile application, and/or electronic media may contain links to other websites and/or electronic platforms. These are not under our control and we do not endorse any of them. If you provide any personal information to these websites and/or electronic platforms, such an action will be under your responsibility. We recommend that you carefully read the privacy policy or other agreements by these websites.

Our Privacy Policy does not extend to cover or apply to external website practices related to data and privacy, including those of allied companies that are not expressly subject to our Privacy Policy.

Our operations are supported by a network of computers, cloud-based servers, and other infrastructure and information technology, including, but not limited to, third-party service providers. 

The parties mentioned above may be established in jurisdictions other than your own and outside the European Economic Area, Switzerland, and the United Kingdom (the “UK”). These countries do not always afford an equivalent level of privacy protection. We have taken specific steps, in accordance with EEA data protection law, to protect your Personal Information. 

7.0 IP address, Cookies, and Aggregate Data

7.1 IP Addresses

It is necessary for Sanam to collect the Internet Protocol (IP) address (i.e., the identifier for your computer when you are using the Internet) of our website users for their interaction with various parts of the Sanam Service. In case Sanam has recorded your IP address, such as when you log in, it is stored for security and audit purposes only. Your IP address will not be used by us or released to any third party except in relation to issues pertaining to security, inappropriate behaviour and/or fraud, which may include issues such as unauthorized access to your computer, our systems, or fraudulent transactions.

Please note that we may use your Internet Protocol (IP) address to analyze your activities and improve our website performance.

7.2 Cookies

A “cookie” is a small text file that is stored on your computer, tablet or phone when you visit a website. Sanam uses “cookies” in order to:

  • provide you with the best online experience possible,
  • assist with managing your Account;
  • identify you on return visits.
  • help Sanam understand more about your preferences in order to deliver a more relevant service. For instance, Sanam may learn from these what kind of offers you like and be able to limit the number of times you see offers not relevant to you.

If you wish to know when or if you receive cookies from the Sanam, you can manually set your browser to notify you of this or, in the case you do not wish to receive cookies, to reject cookies.

We may use Service Providers to help us analyze certain online activities. For example, to help us measure the performance of our online campaigns or analyze visitor activity on Sanam. We may permit our Service Providers to use cookies and other technologies to perform these services for Sanam. It is important to point out that:

  • we do not share any personal information about our users with these Service Providers;
  • these Service Providers do not collect such information on our behalf; and
  • our Service Providers are required to comply fully with this Privacy Policy.

7.3 Aggregate Data

Although Sanam’s systems do not collect any personal or sensitive information from or about visitors to Sanam (website and mobile application), they do collect metadata. Examples of metadata include the date and time of each unique visit, any pages viewed, and any content downloaded. Our systems also log the number of times our visitors click on content featured on Sanam. This information is collected only to further develop Sanam and improve the facilities and/or services we are able to offer.

8.0 Information Security

Sanam takes all reasonable measures to protect your information within our company from loss, misuse, unauthorized access, modification, or destruction. As a matter of fact, no data transmission over the Internet can be guaranteed as entirely secure. We will use all reasonable measures to ensure the security and confidentiality of information and materials in Sanam.

Once we have received your information, we take reasonable steps to preserve the electronic and physical security of this information in accordance with our Terms of Service and this Privacy Policy. Among other measures to keep information and materials in Sanam secure and confidential, Sanam:

  • regularly reviews and adopts new developments in electronic security and encryption technologies.
  • ensures the physical security of any information you might share with us at a Saudi-based Service Provider’s facility under the constant surveillance of security personnel.
    • Our legally-binding agreements with this Service Provider outline the appropriate use and handling of your information and prohibit them from using any of your personal information for purposes unrelated to the service they have been engaged to provide.
    • This Service Provider is bound by our own stringent privacy and security obligations to you, and will be subject to discipline, termination and/or criminal prosecution should they not meet these obligations in their entirety.
  • incorporates bank-level encryptions for financial data/information.

While we have endeavored to create a secure and reliable website and mobile application for users, we cannot claim that information is 100% secure. If you have reason to believe that your interaction with Sanam is not secure, please notify us immediately through our contact details below.

9.0 User Access to Personal Information

In most cases, the user can access, correct or edit the personal information to share with Sanam via the user’s Sanam Account. The user may request access to any personal information which Sanam holds about him/her at any time by contacting us (see the details below).

Where we hold information that you are entitled to access, we will try to provide you with suitable means of accessing it (for example, by mailing or emailing it to you). We may charge you a fee to cover our administrative and other reasonable costs in providing the information to you. Please note that we will not charge for simply making the request and will not charge for making any corrections to your personal information.

There may be instances where we cannot grant you access to the personal information we hold. For example, we may need to refuse access if granting access would interfere with the privacy of others or if it would result in a breach of confidentiality. If that happens, we will give you written reasons for any refusal.

If you believe that the personal information we hold about you is incorrect, incomplete or inaccurate, then you may request us to amend it. We will consider if the information requires amendment. If we do not agree that there are grounds for amendment then we will add a note to the personal information stating that you disagree with it.

10.0 Control Over Communications and Information

When you register to use Sanam, you can configure whether you want us to send direct communications to you. These include communications related to transactional activity on your financial accounts or direct marketing communications.

You can opt out or configure how you receive communications on transactional activity by accessing the “Alert Settings” within your Account Settings. You can opt out of direct marketing communications by selecting Unsubscribe from any marketing emails that you receive. There are, however, certain forms of essential correspondence that users of Sanam cannot opt out of receiving, which include:

  • correspondence pertaining to confirmation of your registration with Sanam;
  • notifications of changes to our Terms of Service and/or this Privacy Policy; or
  • anything else we are required or authorized to send you in accordance with the laws in Saudi Arabia.

Sanam takes all reasonable measures and steps to allow you control over sending and receiving information. You may cancel your Account at any time by accessing the delete account option available through our website and mobile application. Your Account will be disabled immediately and we will disconnect any connection with your Account Information we have established. Sanam reserves the right to use any aggregated and anonymous data derived from your utilization of the Service up to this point.

11.0 Complaint Submission and Process

Sanam is committed to deal with all complaints quickly, efficiently, fairly and in a timely manner, and we take all our users’ and visitors’ feedback seriously. We will be happy to address and/or assist you with any feedback or concern you may have and encourage you to file a complaint with us whenever necessary.

If you believe that your privacy has been breached, please contact us using any of the communication methods below. To help us address your complaint quickly, please provide:

  • your name;
  • contact details;
  • any relevant document or information; and
  • a detailed explanation of problem.

We will review and address your complaint and then provide you with a verbal or written response through an acceptable communication method (e.g. email) as soon as we can; normally within 10 business days but no later than 45 days from the date you first contacted us.
